In a recent academic article, she links \u201ctwo raging debates in administrative law\u201d and makes them relevant to every reader.&nbsp;<\/p>\n\n\n\n<p>\u201cMy goal was to take what are a number of very hot topics in Supreme Court current administrative law but try to present them in ways that are accessible,\u201d says Professor Klein, who spent 30 years litigating for the U.S. Department of Justice before joining <a href=\"https:\/\/law.wilmu.edu\/index.aspx\">Wilmington University School of Law<\/a> full time.&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Alisa Klein\u2019s Analysis of District Court Judges\u2019 Authority&nbsp;<\/h2>\n\n\n\n<p>Her piece in the Administrative Law Review \u2014 <a href=\"https:\/\/administrativelawreview.org\/wp-content\/uploads\/sites\/2\/2024\/06\/ALR-76.2_Klein.pdf\">\u201cMajor Questions Doctrine Jujitsu: Using the Doctrine to Rein in District Court Judges\u201d<\/a> \u2014 focuses on \u201cto what extent individual federal judges at the lowest level, district court judges, have the power to block on a national scale the policies that are put in place by the president and the president\u2019s subordinates,\u201d Professor Klein says.&nbsp;&nbsp;<\/p>\n\n\n\n<p>To make her case, she uses \u201cthe theories that the Supreme Court has given to justify its major questions doctrine.\u201d&nbsp;<\/p>\n\n\n\n<p>\u201cIf you\u2019re an executive branch agency \u2014 like the U.S. Department of Health and Human Services or the U.S. Department of Labor \u2014 you can only do things that Congress, through legislation, has authorized,\u201d says Professor Klein. \u201cIf what you\u2019re doing is a major question, meaning a policy of vast economic, political significance,\u201d the Supreme Court wants \u201cto see specific language from Congress.\u201d&nbsp;<\/p>\n\n\n\n<p>She argues those principles should apply equally when considering \u201cthe role of a single judge within the federal government.\u201d&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">A Case Study: CDC Mask Mandate&nbsp;<\/h2>\n\n\n\n<p>For example, to fight COVID-19, the Centers for Disease Control and Prevention (CDC) required masks on planes and other public transportation, prompting lawsuits. Professor Klein and her team defended the CDC\u2019s position.&nbsp;&nbsp;<\/p>\n\n\n\n<p>\u201cAt that lowest level of district court, one judge said that\u2019s fine, that\u2019s within the power that Congress gave to the CDC, which has explicit power to issue measures that prevent the spread of a communicable disease, and that it\u2019s not a major question,\u201d she says.&nbsp;<\/p>\n\n\n\n<p>However, \u201canother judge, who has no more power than the first in structure and who sits on the same court, reached the opposite conclusion but didn\u2019t just say, \u2018OK you five people who have identified yourselves in this suit don\u2019t have to wear a mask,\u201d Professor Klein explains. \u201cWhat she said is, because what I think the CDC has done is unlawful, I\u2019m knocking it out nationwide.\u201d&nbsp;<\/p>\n\n\n\n<p>Professor Klein contends the role of a single district court judge \u201cis quite modest and is limited to saying, \u2018I\u2019m just resolving no more than necessary to give relief to the people who are suing.\u2019\u201d&nbsp;<\/p>\n\n\n\n<p>\u201cThe article describes a three-prong test that provides a remedy for an aggrieved plaintiff while limiting the ability of the district court to bind entities that were not a party to the actual lawsuit in front of the judge,\u201d says Phillip Closius, dean of Wilmington University School of Law. \u201cProfessor Klein provides an innovative solution to a real problem the district courts have struggled with for years.\u201d&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>Professor Klein currently teaches two WilmU Law courses, Constitutional Law I and Torts, and is writing another article about district court judges\u2019
