The <a href=\"https:\/\/law.wilmu.edu\/\" target=\"_blank\" rel=\"noreferrer noopener\">Wilmington University School of Law<\/a> professor recently participated in three panel discussions and wrote two blog posts for the <a href=\"https:\/\/www.yalejreg.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">Yale Journal on Regulation<\/a>.&nbsp;<\/p>\n\n\n<style>.kb-image12168_116ca2-68 .kb-image-has-overlay:after{opacity:0.3;}<\/style>\n<div class=\"wp-block-kadence-image kb-image12168_116ca2-68\"><figure class=\"alignleft size-medium\"><img loading=\"lazy\" decoding=\"async\" width=\"250\" height=\"250\" src=\"https:\/\/blog.wilmu.edu\/news\/wp-content\/uploads\/2024\/12\/Wilmington-University-Alisa-Klein-250x250.jpg\" alt=\"Alisa Klein\" class=\"kb-img wp-image-16481\" srcset=\"https:\/\/blog.wilmu.edu\/news\/wp-content\/uploads\/2024\/12\/Wilmington-University-Alisa-Klein-250x250.jpg 250w, https:\/\/blog.wilmu.edu\/news\/wp-content\/uploads\/2024\/12\/Wilmington-University-Alisa-Klein-480x480.jpg 480w, https:\/\/blog.wilmu.edu\/news\/wp-content\/uploads\/2024\/12\/Wilmington-University-Alisa-Klein-100x100.jpg 100w, https:\/\/blog.wilmu.edu\/news\/wp-content\/uploads\/2024\/12\/Wilmington-University-Alisa-Klein.jpg 600w\" sizes=\"auto, (max-width: 250px) 100vw, 250px\" \/><figcaption><em>Alisa Klein<\/em><\/figcaption><\/figure><\/div>\n\n\n\n<p>\u201cIt\u2019s a way of staying connected to the various administrative law professors across the country,\u201d <a href=\"https:\/\/law.wilmu.edu\/faculty\/alisa-klein.aspx\" target=\"_blank\" rel=\"noreferrer noopener\">Professor Klein<\/a> says. \u201cThey\u2019re issues that, because of my work, I\u2019ve been thinking about for many years.\u201d&nbsp;<\/p>\n\n\n\n<p>One issue is the power of district court judges, which she and fellow panelists debated during the Administrative Conference of the United States (ACUS) <a href=\"https:\/\/www.acus.gov\/event\/forum-nationwide-injunctions-impact-regulatory-programs-opportunities-and-challenges\" target=\"_blank\" rel=\"noreferrer noopener\">Forum on Nationwide Injunctions<\/a>.&nbsp;&nbsp;<\/p>\n\n\n\n<p>\u201cThe Department of Justice was consistent across administrations over decades. Our position has been: There are roughly 600 individual district court judges. They should be modest in their role and only give relief to the party before them,\u201d Professor Klein says. \u201cThey shouldn\u2019t be blowing up executive branch regulations for the nation.\u201d&nbsp;<\/p>\n\n\n\n<p>She tackled the topic in a Yale Journal on Regulation <a href=\"https:\/\/www.yalejreg.com\/nc\/backing-universal-remedies-into-a-corner-post-by-alisa-klein\/\" target=\"_blank\" rel=\"noreferrer noopener\">blog post<\/a> and an earlier <a href=\"https:\/\/blog.wilmu.edu\/news\/2024\/09\/24\/wilmu-law-professor-alisa-klein-pens-administrative-law-review-article\/\" target=\"_blank\" rel=\"noreferrer noopener\">article<\/a> in the Administrative Law Review. Another piece on universal district court remedies is in progress.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-theme-palette-3-color has-text-color has-link-color wp-elements-369e51b244ccd4b7a05b373ec6d54d5f\">Examining Loper Bright and Chevron<\/h2>\n\n\n\n<p>\u201cI don\u2019t think anyone was surprised that when the Supreme Court had the opportunity that they overruled it,\u201d Professor Klein says. \u201cIt\u2019s not really a partisan issue. It\u2019s just a power issue.\u201d&nbsp;<\/p>\n\n\n\n<p>At a <a href=\"https:\/\/inns.innsofcourt.org\/for-members\/inns\/the-richard-s-rodney-american-inn-of-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">Richard S. Rodney Inn of Court<\/a> event, she and others analyzed Loper Bright for an audience of about 250 Delaware lawyers. Professor Klein also organized a virtual panel for the American Bar Association (ABA) Administrative Law Fall Conference, calling it \u201cWas the Push To Overrule Chevron Much Ado About Nothing?\u201d&nbsp;&nbsp;<\/p>\n\n\n\n<p>\u201cMy personal view is \u2014 yes,\u201d she says. \u201cThis weight that courts were supposed to give agency interpretations had long not had a lot of real-world effect.\u201d&nbsp;<\/p>\n\n\n\n<p>\u201cDelaware was one of the first states to repeal Chevron deference, and having this perspective into the future of the administrative state was a fascinating exercise,\u201d says ABA panel moderator <strong>Neena Menon<\/strong>. \u201cAll the panelists provided useful insights for the future of administrative deference on the federal level and tools for practitioners to actually use the new frameworks in litigation.\u201d&nbsp;<\/p>\n\n\n\n<p>Looking ahead, Professor Klein feels consistency will be key.&nbsp;<\/p>\n\n\n\n<p>\u201cI find it underscores the difference between policy and legal reasoning because you have to be consistent,\u201d Professor Klein says. \u201cAnd one thing everyone is now looking to see is: Will the Supreme Court be consistent?\u201d&nbsp;<\/p>\n<\/div><\/div>\n","protected":false},"excerpt":{"rendered":"<p>After 30 years litigating for the U.S. Department of Justice, Alisa Klein happily shares her expertise \u2014 in and out of the classroom.
